TERMS AND CONDITIONS – ELEVIA

1. Purpose of the Terms and Conditions

These Terms and Conditions govern the contractual relationship between ELEVIA (hereinafter "the Seller", "we" or "Elevia") and any natural or legal person ("the Customer" / "the User") who accesses and uses the website www.elevia.ro or places orders through it.

By using the website and/or placing an order, the Customer declares that they have read, understood and fully accept these Terms and Conditions.

Customer support hours: Monday – Friday, 10:00 – 18:00, except public holidays.

4. General rules for using the website

4.1. The website may be used by persons who are at least 18 years old.
4.2. Minors may use the website only with the consent of their legal representative.
4.3. The Customer is regarded as a consumer within the meaning of Romanian Government Emergency Ordinance (OUG) no. 34/2014 when purchasing products for personal, non-professional purposes.
4.4. By creating an account or placing an order, the Customer consents to the processing of personal data in accordance with the Elevia Privacy Policy.

5. Products

5.1. The products displayed on the website are presented for information purposes (description, materials, images).
5.2. Product images are indicative; slight colour differences from the actual product may occur, depending on the user's device settings.
5.3. The products are intended for personal use only.

6. Orders

6.1. Orders are placed exclusively online on www.elevia.ro.
6.2. Adding products to the cart does not amount to placing a firm order.
6.3. The order becomes firm once the checkout process is completed and the Terms and Conditions are accepted.
6.4. Elevia reserves the right to contact the Customer for additional confirmations regarding the order.

7. Prices and payments

7.1. All prices are expressed in LEI and include VAT.
7.2. Delivery costs, if any, are displayed separately before the order is completed.
7.3. Available payment methods:

  • cash on delivery (payment in cash upon delivery)

  • online card payment (through authorised payment processors)

8. Delivery

8.1. Delivery is carried out within the territory of Romania.
8.2. The delivery time is normally 1–3 business days from the moment the shipment is confirmed.
8.3. During busy periods, or for reasons beyond Elevia's control, delays may occur.

9. Right of withdrawal (returns)

9.1. In accordance with Government Emergency Ordinance (OUG) no. 34/2014, the Customer has the right to withdraw from the contract within 14 calendar days of receiving the product, without giving any reason.
9.2. Products must be returned in intact condition, unused, in their original packaging and with all accessories.
9.3. Return costs are borne by the Customer, except where the product is defective or was delivered in error.

10. Exceptions to returns

The following products cannot be returned:

  • products that have been used or damaged;

  • products showing signs of wear;

  • products that are no longer in their original packaging.

11. Refunds

11.1. Refunds are made within a maximum of 14 calendar days of receipt of the returned product.
11.2. The refund is made using the same payment method used originally, or by bank transfer.

12. Warranty of conformity

The products benefit from a statutory warranty of conformity of 24 months, in accordance with the Romanian legislation in force.

13. Liability

Elevia is not liable for:

  • improper use of the products;

  • any technical errors of the website;

  • delays caused by courier companies.

Elevia's maximum liability towards the Customer is limited to the value of the order paid.

14. Intellectual property

All content of the website www.elevia.ro (texts, images, logo, graphic elements) is the property of Elevia and may not be used without prior written consent.

15. Governing law and jurisdiction

This contract is governed by Romanian law. Any disputes will be resolved by the competent courts of Romania.

16. Changes

Elevia reserves the right to modify these Terms and Conditions at any time. The updated version will be published on the website and will take effect from the date of publication.
